Town negotiates for larger development in midtown core By David Lea OAKVILLE BEAVER STAFF 7 · OAKVILLE BEAVER Wednesday, April 8, 2009 An arrangement between the Town of Oakville and Creekbank Properties has yielded a development of greater size than what the developer was initially requesting. Creekbank Properties had been calling on the Town to change the zoning for the land at 599 Lyons Lane to permit the building of 420 residential condominium units in two high-rise towers, which would be 20 storeys and 24 storeys in height. This new agreement, approved by council last week, will see an increase to these figures with the residential condominium now consisting of 480 units in two high-rise towers, which would be 24 storeys and 26 storeys in height. "It was a grind of a process at times, but very gratifying at the end of the day," said Creekbank President Todd Cullen. "Both parties have shown compromise as well as a willingness to work together to come up with something that represents positive growth and development." Cullen went on to note that in exchange for the approval of his development's enhanced height Creekbank agreed to fund some infrastructure projects in the area. In particular, Cullen said, Creekbank will spend between $1.5 million and $2 million on road improvements associated with the development. This includes a signalized intersection at the corner of Lyons Lane and Cross Avenue. Creekbank will also contribute $400,000 towards upgrades in the midtown area including a number of pedestrian improvements. Beyond this, Oakville's Commissioner for Planning and Development Jane Clohecy noted, the development fits in with what the Town has planned for the area. "This site is within our midtown area, so it has been identified by the province in `Places to Grow.' It's got some minimum requirements in terms of the kinds of scale and development that you have to achieve so this site moved us a long way to getting to those midtown requirements," said Clohecy. From an environmental point of view the Town also succeeded as it was able to protect the valley slope by convincing Creekbank to move the development to a point on the site that is farther away from 16-Mile- Creek. "I think this was a terrific settlement, this advances every one of the town's goals and brings extra benefit as well," said Oakville Mayor Rob Burton. "We got everything we wanted and more. It's very important to the town that midtown be a success and this represents a kick start to it." Cullen concurs. "I think the Town has done a responsible job in terms of getting what it needs from a development like this and we at the end of the day are quite happy with the form the development has taken," said Cullen. Despite a lack of public opposition, the development was appealed to the Ontario Municipal Board (OMB) on the grounds that the Town was taking too long to deal with the issue. The agreement between the Town and the developer was reached before OMB sessions began. Cullen said a large amount of behind the scenes work still needs to be done before construction on the two towers can begin with a start date tentatively scheduled 12-18 months in the future.
